Contractual duties for repairs
The landlord may be held to specify obligations to make repairs under the terms of the tenancy agreement. These are typically referred to as express commitments. even if the tenancy agreement contains no stated obligations.
The landlord and tenant statute of 1985 imposes a strict duty on all landlords to make necessary repairs. It makes it an implied condition of every lease that the landlord will maintain the building’s interior and exterior, as well as the systems for providing water, gas, and electricity, as well as sanitation, space heating, and hot water.
Importantly, the landlord has a legal obligation to repair even if a tenant owes rent or has violated a tenancy agreement.
